It is not uncommon to see people get involved in business or any form of transaction first, without involving a lawyer.
In fact, research has it that a lot of people, about 70% do not see the need for a lawyer or to get a lawyer involved in their daily dealings until they have found themselves in trouble.
The truth is, as a smart person that is strategic and tactical, you should not sign any agreement whatsoever without involving your lawyer based on the following under listed reasons:
- TECHNICAL LEGAL TERMS:
Every profession has its terminologies and so also is the legal profession… In fact,legal stake holders are the master of all professional terminologies, and most of the legalese (terminologies) often referred to as “legal jargons” are gotten from Latin.
It only takes a person that is well vast in that field and who has spent almost a lifetime learning it to know and understand what a particular document is actually saying.
So, the rule is simple… Don’t sign what you don’t understand.
- FAVOURITISM:
This is simple and straight to the point, every Lawyer will always protect the interest of his client, just like the goal of your lawyer is to protect your interest as well when you engage and retain his or her legal services.
It is therefore not wise and legally unhealthy for you to sign what another Lawyer drafted for and on behalf of his client without having your own Lawyer go through it…….
Save and except you are a Lawyer by compulsion.
- A PROMISE IS A DEBT:
Yes! Whatever you sign for and agree to automatically become your bond, especially when you sign it as an adult with all soundness of mind. This is one reason legal agreements contains what is called “covenants”
And what is a covenant?
A covenant is an undertaking, a pledge, promise, vow, guarantee, warrant etc.
In other words, a covenant is when you commit yourself to doing something willingly……..without any form of compulsion or duress.
And of course, once you break any covenant, there are always consequences, but in this case legal consequences on your side which becomes the legal remedy the other party you broke your covenant against will be seeking.
Hence, you must not promise anything by signing it without allowing your lawyer review and explain it to you for a proper understanding.
- IGNORANCE IS NO EXCUSE:
I’m so sure, you are not just hearing this phrase for the first time!
Yes! It’s as simple as that….
“had I known” or “I did not know” is alien in Law
The law is not interested in your ignorance, because you are deemed to know and if you do not know, you are therefore to consult with an expert in that field to adequately put you through and not to go on a frolic of your own.
In Conclusion:
You are obliged (under the law) to keep the terms of any agreement you sign or pay dearly for not sticking to it.
Now you know…
Consult with your Lawyer to draft, read and interpret any Agreement before yousign it.
Remember, your signature is your symbol of authority, honour and integrity.
Make it count when you append it to any black and white document.
